Plaza Boat Care BV - Terms and Conditions

1. Introduction

These Terms and Conditions govern the services provided by Plaza Boat Care BV ("Company") to you ("Customer") for boat maintenance, repair, and other related services for yachts and motorboats. By using our services, you agree to these terms.

 

2. Services Offered

Plaza Boat Care BV provides maintenance, repair, and parts replacement for motorboats and yachts. All work will be completed in accordance with industry standards and manufacturer’s guidelines. The Company reserves the right to refuse services based on the condition of the boat or if specific materials are unavailable.

3. Estimates and Pricing

  • 3.1 All estimates provided are based on the initial inspection. Final costs may vary due to unforeseen circumstances such as additional parts or labor required.

  • 3.2 Customers will be notified of any necessary additional work beyond the original estimate. The work will only proceed with customer approval.

  • 3.3 Prices are subject to change without prior notice, but approved estimates will be honored unless additional work is needed.

4. Payment Terms

  • 4.1 Payment for services is due upon completion of the work unless otherwise agreed upon in writing. Payment options include bank transfer, debit/credit card, and cash.

  • 4.2 Plaza Boat Care BV reserves the right to charge interest on late payments at a rate of 4% per month on overdue amounts.

  • 4.3 A lien may be placed on the customer’s boat or property if payment is not made within 30 days after invoicing. Plaza Boat Care BV has the right to hold the vessel until the balance is paid in full​

5. Ownership and Risk

  • 5.1 Ownership of parts or equipment installed remains with Plaza Boat Care BV until payment is received in full.

  • 5.2 The risk of damage or loss of the vessel passes to the customer when the vessel leaves the Company's premises or when the service is completed​.

6. Warranties

  • 6.1 Plaza Boat Care BV guarantees its workmanship and parts for 12 months from the date of service.

  • 6.2 Any repairs or modifications performed by third parties without prior consent from Plaza Boat Care BV will void the warranty.

  • 6.3 The warranty does not cover damage caused by misuse, neglect, or failure to follow manufacturer’s maintenance guidelines​

7. Liability

  • 7.1 Plaza Boat Care BV will not be held responsible for any indirect, incidental, or consequential damages arising from the use or inability to use the vessel after services have been rendered.

  • 7.2 While the vessel is on our premises, Plaza Boat Care BV will take reasonable precautions to ensure its safety but will not be liable for damage caused by external events such as theft, fire, or weather​

8. Delays

  • 8.1 Plaza Boat Care BV will provide estimated timeframes for work completion; however, delays may occur due to parts availability, unforeseen technical difficulties, or other factors beyond the Company's control. The Company will not be liable for any loss or damage caused by such delays​(

9. Subcontracting

  • 9.1 Plaza Boat Care BV may, at its discretion, subcontract specific tasks to qualified third parties without notice to the customer. Subcontracted work will be subject to the same terms and warranties as work performed by Plaza Boat Care BV​(

10. Vessel Movement

  • 10.1 Plaza Boat Care BV reserves the right to move any vessel for safety, security, or operational purposes while in our care. This includes, but is not limited to, moving the vessel to different locations on our premises​

11. Force Majeure

  • 11.1 Plaza Boat Care BV will not be liable for any delays, damages, or losses caused by circumstances beyond our control, including but not limited to natural disasters, extreme weather, fire, labor disputes, or supply chain disruptions​

12. Governing Law and Dispute Resolution

  • 12.1 These Terms and Conditions are governed by the laws of Bonaire. Any disputes arising from the use of our services will be subject to arbitration in Bonaire. If arbitration is not successful, disputes may be brought before the courts of Bonaire​(

13. Modification of Terms

  • 13.1 Plaza Boat Care BV reserves the right to modify these Terms and Conditions at any time. The updated terms will be posted on our website, and continued use of our services constitutes acceptance of the updated terms​
